Terms of Service
These Terms of Service (the “Terms”) form a binding agreement between you and EatBright (“EatBright”, “we”, “us”) and govern your access to and use of the EatBright mobile and web app, website and related services (together, the “Service”). By creating an account or using the Service you agree to these Terms.
1. Who we are
EatBright is operated by Marius Lė, an individual conducting business under Lithuanian Individual Activity registration. Contact: eatbright.support@gmail.com.
2. Eligibility & accounts
You must be at least 16 years old (or the age of digital consent in your country) to use the Service. You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately at eatbright.support@gmail.com if you suspect unauthorised use.
3. Subscriptions, billing and renewal
- EatBright is offered on a paid subscription basis (weekly or yearly plans).
- Subscriptions renew automatically at the end of each billing period at the then-current price until cancelled. You can cancel at any time from the in-app billing portal; cancellation takes effect at the end of the current paid period.
- Payments are processed by Stripe. By subscribing you also agree to Stripe’s applicable terms.
- Prices are shown in EUR and may include or exclude taxes depending on your country and our tax status.
- Promotional pricing applies only to the period stated in the offer; standard pricing applies afterwards.
4. Right of withdrawal & refunds
EU/EEA consumers normally have a 14-day right of withdrawal for digital services. By starting to use the Service immediately after purchase you expressly request immediate performance and acknowledge that you lose the right of withdrawal once the service has been fully performed. 5. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, or fraudulent purposes;
- Upload content that infringes third-party rights or contains malware;
- Attempt to reverse engineer, scrape, or disrupt the Service or its AI features;
- Resell, sublicense, or use the Service to build a competing product.
6. AI features
EatBright uses AI to estimate calories, macronutrients and meal contents from photos and text you submit. AI output is an estimate and may be inaccurate. You are responsible for reviewing and correcting logged values. See also our Health Disclaimer.
7. Your content
You retain ownership of meal photos, recipes, weights and other data you submit (“Your Content”). You grant EatBright a limited licence to host, process and display Your Content solely to operate the Service for you. We do not sell Your Content.
8. Intellectual property
All rights in the Service, including software, branding and design, are owned by EatBright or its licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Service for your personal, non-commercial use during your active subscription.
9. Disclaimers
The Service is provided “as is” and “as available”. EatBright is a wellness and tracking tool and does not provide medical advice. To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose and non-infringement.
10. Limitation of liability
To the maximum extent permitted by law, EatBright will not be liable for indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill arising from your use of the Service. Our total liability for any claim is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) EUR 50. Nothing in these Terms limits liability that cannot be limited by law (e.g. statutory consumer rights).
11. Suspension & termination
You may stop using the Service and delete your account at any time from the Profile screen. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to other users or to EatBright.
12. Changes to the Service or Terms
We may update the Service and these Terms from time to time. Material changes will be communicated in-app or by email and take effect on the date stated. Continued use after the effective date means you accept the updated Terms.
13. Governing law & disputes
These Terms are governed by the laws of the Republic of Lithuania, without prejudice to mandatory consumer protection rules in your country of residence. EU consumers can also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
